Clutch may not be adjusted correctly, clutch may not be fully disengaging hence making it difficult to shift.

Is there enough free play at the lower end of the clutch cable? If not that will cause it to be difficult to change gears also.

    yes
it'll shift 1st to second. just not 3rd and up. if im stopped i can manually pull up on the shift lever and get it into 3rd, 4th, 5th. but it takes alot of effort. and it cant be be good on the shifter to pull on it that hard.

Don`t do anything , disassembly or otherwise . Take it to the dealer you bought it from . The have to fix it if it is a new bike , no question .

U-Haul rents trailers with a chock for a motorcycle front tire. You're going to have to get it there somehow.

dealer contacted me and said bike is fixed. said it was a bent shift rod. probably from an impact. no impact to speak of. been pretty much babying the bike since I've had it. haven't hit anything or laid her over. but at least it's fixed. or so they say. won't be able to pick it up and check for sure til Tue. we're gonna see. anxious to ride her though. only had 330mi on it before this issue. will keep you updated...

That would be the shift rod between the foot lever and the pivot arm on the left side lower of the bike. Not inside the engine. This has happened to a few that I have fixed. I was going to suggest this, but obviously late to the conversation.
I am almost always working on a bike. If you have questions and need an answer quickly, just call me. 317-507-0940. Always up late. There will be time for sleep when I am dead!

why would it only affect 3rd 4th and 5th tho ?

That remind me of something that happened to me some time ago with my Indian Chieftain … I bought a set of floorboards from Kuryakyn for the bike and when I installed them , I started to have problems shifting to 2nd gear . I called the dealer and made an appointment and two days later I went there . It turns out that the Kuryakyn floorboards are much thicker than the factory floorboards so it were interfering with the linkage . It took the dealer mechanic 10 minutes to fix it and they didn`t even charged me for it .
I am surprised that a brand new bike with such a little issue the dealer will charge $292.00 for it and would not add it to the warranty … just saying !!!

believe me i know. they also said the repair was about 4weeks out(busy shop). so getting it fixed in a few days was nice. but yeah, it still sucks im out nearly $300 for something that totally should be a warranty issue.

    Any update on this?
Have you ridden the bike much after the fix? I have a shifting concern and am hoping maybe its a quick fix like this?

Curious if you have photos of what was replaced exactly?

I hit a deer Saturday. He caught my left signal and the bottom of my foot. That drove the top of my foot into the shifter. Shifts up ok, missed 2nd for the first time ever. 2007 bike I’ve had since 2015. Sometimes shifting down is tough and I’m pretty sure the shifter is not where it was before. Almost like the rod was stretched.
